Embattled Lagos lawmaker, Mudashiru Obasa, has taken legal action to challenge his removal as Speaker of the Lagos State House of Assembly, insisting that his ouster was unconstitutional.
Obasa, who was removed on January 13, 2025, by 36 lawmakers while he was out of the country, has now filed a lawsuit at the State High Court in Ikeja, naming the Lagos State House of Assembly and the new Speaker, Mojisola Meranda, as defendants.
Legal Battle Begins
In a motion dated February 12, 2025, Obasa’s legal team, led by Chief Afolabi Fashanu, SAN, is seeking:
🔹 An expedited hearing of the case.
🔹 A court order shortening the response time for the defendants to seven days.
🔹 An abridged timeframe of three days for his legal team to reply to counter-arguments.
Grounds for His Challenge
Obasa’s legal arguments are based on the 1999 Constitution (as amended) and the Standing Orders of the Lagos Assembly, asserting that:
✔️ The Assembly had no constitutional authority to sit during recess without the Speaker reconvening it.
✔️ The legality of Meranda’s leadership needs urgent determination.
✔️ The matter is of public interest and must be resolved quickly to avoid legislative gridlock.
Part of the motion reads:
“Public interest requires the case to be heard and determined speedily and expeditiously so that legislative activities in the state are not stalled.”
Awaiting Court Date
Despite the urgency of the suit, no date has been fixed for the hearing as of the time of filing this report.
