The Court of Appeal, Abuja Division, has nullified the July 15 ruling of the Kano High Court in the legal battle between Ado Bayero and Mohammed Sanusi, citing a breach of fair hearing.

Key Rulings:

  • Fair Hearing Breach: The appellate court ruled that Ado Bayero was denied the opportunity to present his case due to the Kano High Court’s failure to serve him a hearing notice.
  • Sanusi’s Case: The court also noted that Mohammed Sanusi should have been properly notified to submit his grievances before the initial ruling.
  • Lower Court’s Judgment: Described as “shoddy,” the proceedings were deemed a travesty of justice by the appellate court.

Orders:

  • The case has been remitted to the Chief Judge of the Kano State High Court for reassignment to a different judge for expedited hearing.
  • The appellate court emphasized that the issue of fair hearing, being paramount, resolved the appeal in Bayero’s favor without the need to address other matters.

This decision underscores the judiciary’s obligation to uphold justice by ensuring all parties are given equal opportunities to be heard.
