The Osun State Government has approached the High Court in Osogbo, asking it to compel the Inspector-General of Police and the state Commissioner of Police to investigate Senator Francis Fadahunsi over alleged inflammatory comments ahead of Saturday’s governorship election.
The suit, marked HOS/M.157/26, was filed on August 12, 2026, by the state Attorney-General and Commissioner for Justice, Oluwole Jimi-Bada, at the High Court of Justice, Osogbo Judicial Division.
Fadahunsi, who represents Osun East Senatorial District, was listed as an affected or interested party in the case.
The legal action followed the circulation of a video in which the senator was allegedly heard making threatening remarks against members and supporters of the Accord Party.
The state government alleged that Fadahunsi called on members of the All Progressives Congress to “kill Accord Party members anywhere they see them.”
It further alleged that the senator extended the threat to the relatives of Accord members, including their wives and children.
The application stated, “The said Senator is further alleged to have stated that Accord Party members have wives and children and that APC members should kill them all, thereby extending the incitement to violence against innocent family members and constituting a direct threat to life and family security.”
The government also accused Fadahunsi of allegedly directing APC members to drive Accord Party supporters from hotels and describing them as “not normal human beings” because they wore yellow caps.
Consequently, the state asked the court to order the police to obtain, preserve and conduct a forensic examination of the “complete and unedited version” of the video.

It also wants the police to investigate how and where the video was recorded, when it was made, who was present, and the identities of those who allegedly sponsored, published or circulated it.
The government argued that the alleged comments, if authenticated, could pose a serious threat to public safety and the conduct of the election scheduled for August 15.
“The contents of the said publication, if authenticated through proper investigation, constitute matters of the gravest public security concern,” it stated.
According to the state, the remarks were “inherently capable of creating widespread fear, encouraging political violence, threatening lives, endangering families” and contributing to a possible breakdown of law and order.
The Attorney-General further asked the court to direct the police to take preventive measures to protect Accord Party candidates, members, supporters, agents, voters and other residents who could be at risk.
It also requested that the police invite, question or arrest anyone found culpable where investigations establish that an offence had been committed.
The government specifically asked that any criminal proceedings arising from the investigation be pursued “without regard to political status, public office, or political affiliation.”
It also sought an order preventing anyone acting on the alleged statements from intimidating, threatening, attacking or harassing Accord Party members or interfering with voters’ right to cast their ballots freely.
The state requested that the police submit a report detailing the steps taken within 48 hours of the court granting the application, or within any other period the court considers appropriate.
Explaining the urgency of the matter, the government said citizens could not effectively exercise their political rights if they feared violence because of their political affiliation or voting choices.
“The fundamental right to political participation, including the right to vote and be voted for, cannot meaningfully exist where citizens reasonably fear that they may be attacked, killed, chased from hotels, harassed, or intimidated because of their political affiliation, dress, symbols, or voting preference,” it stated.
The state also maintained that political office holders were not exempt from criminal law.
“No holder of political office, irrespective of status, party affiliation, elective office, or membership of the National Assembly, is above the criminal law of the Federal Republic of Nigeria,” the government said.
It urged the court to grant the application in the interest of “justice, public safety, electoral peace, public order, and the rule of law.”
Fadahunsi had come under criticism on Tuesday following the alleged comments against Accord Party members ahead of Saturday’s election. The senator was subsequently invited by the police, questioned and released on Wednesday.
